An increasing number of MLSs, associations, and brokerages are being sued as part of the class action lawsuits surrounding how compensation is paid to seller and buyer brokers/agents. As these compensation lawsuits continue to multiply, we understand you may be getting questions from your clients. You may also have questions about how they impact how you transact your business.
To help you understand the current legal landscape, Bay East is holding a virtual session with Attorney Tom Jacobson, Esq, Thursday, February 22, 12-1:30 pm, covering critical topics such as:
While this session will focus on the legal issues surrounding the litigation, it is not intended to provide legal or transactional advice. Bay East will be hosting several events in the near future that will focus on the C.A.R. forms that help protect you in your commission negotiations with clients.
This event will not be recorded. You can register online here.
Each year, the Association recognizes members for our most prestigious awards. Congratulations to the 2023 Award Winners!

A proposed class action lawsuit relating to real estate broker compensation has been filed against the Bay Area Real Estate Information Service (BARIES) a broker-owned multiple listing service serving real estate professionals in Marin, Sonoma, Napa, Solano, and Mendocino counties and the National Association of REALTORS® (NAR), RE/MAX, Anywhere and others. This lawsuit appears to be of a similar nature to the highly publicized lawsuit brought against NAR and others in Missouri Federal Court. The Defendants have announced they will be vigorously contesting the matter, in part because unlike other Multiple Listing Services, they are not an NAR-related MLS.
Bay East will keep you advised regarding this litigation. If you are contacted by anyone involved in the litigation, we suggest you contact Tricia Thomas, Bay East CEO before engaging in any comments or discussions.
The California Association of REALTORS® has a summary of the litigation and what it means for brokers and agents.
