If a Complaint Has Been Filed Against You

Don't panic! A complaint is an allegation that a Code of Ethic Article, MLS Rule or other membership duty may have been violated by your actions or non-actions. Click here to go the Code of Ethics or MLS Rules.

You have very important due process rights including:

  1. The right to a full and fair hearing
  2. Before an impartial hearing panel
  3. With knowledge of the charges against you
  4. The opportunity to defend yourself
  5. The right to be represented by legal counsel, or an Ethics Advocate

Ethics Advocates are specially trained Professional Standards members that can assist you with the process of preparing a response and even attend the hearing with you.

The party that filed the complaint is known as the "Complainant"; the party that is filed against is known as the "Respondent".

As the respondent in the is matter, keep these guidelines in mind:

File your response in a timely manner.

You will be sent a roster of the eligible Professional Standards panel members; you have the right to challenge any member on the list that you do not want as a potential panelist.

Note that all elements of the complaint process are carefully timed to provide all parties with due process. Do not delay in responding to any notices or requests from the Association.

Prepare six copies of all documents and evidence you intend to present at the hearing. Failure to make sufficient copies may result in a $50 fee for copies made.

You also have the right to ask for Mediation with the complainant to try to resolve the issue before going to a full hearing.
